'I would like to say that the provisions of AFSPA are very pious to me and I think to the entire Indian Army. We have religious books, there are certain guidelines which are given there, but all the members of the religion do not follow it, they break it also, does it imply that you remove the religious book or you remove this chap. My take on it is to find someone guilty, take him to task, but don't touch this pious document or provisions of AFSPA' ____ Lt. Gen BS Jaswal.
Before we move on to make a dispassionate analysis of the Indian Army's Northern Command Chief's statement on AFSPA, it is in place to mention that Armed Forces Special Powers Act, which contributes to the climate of impunity (from legal action) for armed forces in J&K and which is in operation since 1990, is an amended form of Armed Forces Special Powers Ordinance of 1942 of imperialist British which Viceroy Lord Linlithgo brought in force on 15 August 1942 to quell 'Quit India Movement". The Act gave unbridled powers to the British troops. The British left but waking up to the dawn of freedom, India not only preferred to live with it, but added more canine teeth to it in an amendment in 1958.
General Sahab's comment has evoked a widespread condemnation from human rights groups, civil society, media and leadership from across the political and ideological divide in Kashmir. But I think General should have been applauded for making a candid expression. To give vent to what authorities in India and its think tanks and media, even its civil society, do believe in but have reservations in admitting in public. He has blown off the covers of double-speak and shown how Indian Army is 'divinely' operating in Kashmir. While Delhi goes in sync with his line of thinking, its democratic veneer doesn't allow it to speak in General's tune. While it pussyfoots, the General puts up the brave, smart and honest face. We salute General for his moral courage to speak from his heart. Why should knives be drawn against the commandant when what he said has had the blessing, backing and support from Delhi.
General's penchant for his unalloyed expressions reminds us of his press briefing at his Udhampur headquarters. Where he, above other things, equated frequent street protests and shut downs with 'agitational terrorism' and thus 'a cause of worry' for India and advocated for 'presence of security forces till the threat of re-emergence of militants is totally eliminated' (GK: November 01, 2009), This statement in itself reveals the intent behind in having AFSPA "guide" the forces in 'disturbed' area. Read it with his latest, there is no fudge, no ambiguity. The 'cause of worry' is not militancy, it is the people, agitating on streets, though not with guns in hand but entire world of innocence to put up before the bullets and tear gas shells that is a new breed of "terrorism" AFSPA has to take care of after militancy stands defanged and made visibly invisible.
This 'cause of worry' has equally been shared by the political establishment and opinion moulding class in Delhi who endorsed it being pro-actively silent. It is not an "error of judgement" made by the General that needs second look. It is his conviction that gets mirrored in his statement. He is unambiguously clear and, yes, truthful to hold and make us believe that Armed Forces in Kashmir are pitted against the rebel Kashmiris to wean them off 'secessionist' fold and win them in lap. And for this Yudh the Generals would find 'entire nation at their back'. That is why tragedies like Nadihal, where three Nadihal youth after being lured for employment, were killed by troops at Machil (Kupwara) near LoC for promotion and gallantry award, do not cause ripples in the political waters of India and meet frigid response from its Civil society.
That said and done, General's 'pious' remark does not hinge on reason. It is terribly unconvincing. Comparison of the black law with religious scriptures and lending it the touch of holiness is incomparable. Religion curbs animal instinct and values life and calls for its protection.
When have mortal souls graduated to the level of gods where what they say has religious sanction. Which angel from God has descended on General Jaswal to reveal onto him His blessed scripture? Or, has His Lordship in the Heaven been given up to the "Lord" of this part of the planet to claim "divine" robes. And then you claim to be a 'disciplined' force of a 'secular' country where enactment of all laws and their execution is all man-made. And subject to exigencies of time and circumstances. Only those laws are allowed to stay which are pro-people.
AFSPA is a man-made law, not a pious document. As laws keep changing, amendments are being made in them or their revocation sought and done when their lethal toxicity becomes unbearable. Indian constitution is held a sacred document and any infringement of it makes the offender liable for legal action. But if too did not preserve its "virginity". Near about hundred amendments in it are a testimony of man's limitations. Its vulnerability to foresee future. Perhaps General believes in "honor" killing so as to protect the sanctity of institution of unaccounted power and quell the dissent on continuation or revocation of the dreaded law.
The "sanctity" of the law, the brainchild of colonial British was first challenged by Gandhi himself and his Congress. Their 'agitational terrorism' too was sought to be curbed by promulgation of AFSPA. So there is nothing holy in the law. See how aggressive nationalism blinds the eyes. Indians under the Gandhian leadership voicing their anger against 'agitational terrorism' the law loses its holiness, Kashmiris and civil society doing the same is sacrilegious. That reveals India approaches Kashmir copying Lord Linlithgo. And General is on right track in having an honest appreciation of the situation that prevails in Muslim majority parts of Kashmir.
Holy legislations do not differentiate people on colors, race, region, and creed. Their holiness encompasses all. If provision of AFSPA are pious, why not make a proclamation by Prathiba Patil and introduce it throughout India so as to meet demands of equitable justice. The fact of the matter, however, is that AFSPA snatches life, dignity, and honor of people. And that is the "commodity" that fetches cheap in Kashmir.
We know Delhi resorted to a 'constitutional' route in bringing Muslim majority regions of the state under the ambit of black laws. Disturbed Areas Act and AFSPA were invoked in Governor and President's rule and when NC government took over in 1996 it not only continued with these acts in the valley but also extended these to Muslim majority areas of Jammu. True AFSPA was not droned by Delhi on Kashmir, it pursued 'legal means'. But the question is why rulers in Delhi do not listen to the 'elected representatives' when they express their disgust and anger over the continuation of these laws and press for their revocation. Why it is other way round when it doesn't suit Delhi. Omar Abdullah has unequivocally registered his dissatisfaction on AFSPA and has made a strong pitch for changes in it to make it more transparent. . 'Because of the AFSPA because it is built for the armed forces', believes Omar Abdullah, 'Army is the judge, jury and hangman. Therefore, there is absence of transparency as a result of which people have lost faith in the syatem' (GK 6 June, 2010). Not only this, he has raised 'question marks' over the 'encounter killings' in the backdrop of recent Machil fake encounter. That amply demonstrates "holy" character of the AFSPA

A wife's appeal for justice


I am the wife of Mohammad Afzal, the man accused of conspiring to
attack the Indian Parliament on December 13, 2001. Afzal has been
condemned to death by the Sessions Court Judge, S N Dhingra and his
death sentence has been confirmed by the Hon'ble High Court of Delhi.
Now the case has come up before the Hon'ble Supreme Court of India.
All over India people have condemned the attack on Parliament. And I
agree that it was a terrorist attack and must be condemned. However,
it is also important that the people accused of such a serious crime
be given a fair trial and their story be fully heard before they are
punished. I believe that no one has heard my husband's story and he
has so far never been represented in the court properly.
I appeal to you to hear our story and then decide for yourselves
whether justice has teen done. Afzal and my story is the story of many
young Kashmiri couples. Our story represents the tragedy facing our
people.
In 1990 Afzal was attracted to the movement led by the JKLF, like
thousands of other youth. He went to Pakistan for training and stayed
there for a little while. However, he was disillusioned by the
differences between different groups and he did not support
pro-Pakistani groups. He stayed there only three months without
getting any training. Afzal returned to Kashmir and he went to Delhi
to pursue his studies. He always wanted to study and before he joined
the movement he was doing his MBBS.
My husband wanted to return to normal life and with that intention he
surrendered to the BSF. The BSF Commandant refused to give him his
certificate till he had motivated two others to surrender. And Afzal
motivated two other militants to surrender. He was given a certificate
stating that he was a surrendered militant. You will not perhaps
realise that it is very difficult to live as a surrendered militant in
Kashmir but he decided to live with his family in Kashmir. In 1997 he
started a small business of medicines and surgical instruments in
Kashmir. The next year we were married. He was 28 years old and I was
18 years.
Throughout the period that we lived in Kashmir the Indian security
forces continuously harassed Afzal and told him to spy on people they
suspected of being militants. One Major Ram Mohan Roy of 22 Rashtriya
Rifles tortured Afzal and gave him electric shocks in his private
parts. He was humiliated and abused.
The Indian security forces used to regularly take Afzal to their camps
and torture him. They wanted to extract information from him. One
night the Indian security forces came to our home and abused all of us
and took away Afzal to their camp; another time he was taken to the
STF (State Task Force) camp Palhalan Pattan.
Some days later they took him to the Humhama STF camp. In that camp
the officers, DSP Vinay Gupta and DSP Darinder Singh demanded Rs one
lakh. We are not a rich family and we had to sell everything,
including the little gold I got on my marriage to save Afzal from the
torture.
Afzal was kept in freezing water and petrol was put into his anus. One
officer Shanti Singh hanged my husband upside down for hours naked and
in the cold. They gave electric shocks in his penis and he had to have
treatment for days.
You will think that Afzal must be involved in some militant activities
that is why the security forces were torturing him to extract
information. But you must understand the situation in Kashmir, every
man, woman and child has some information on the movement even if they
are not involved. By making people into informers they turn brother
against brother, wife against husband and children against parents.
Afzal wanted to live quietly with his family but the STF would not
allow him.
You should also know that the STF force is notorious in Kashmir for
extorting money from the people and they have become so infamous that
when Mufti Sayed became the Chief Minister he promised in his election
manifesto to disband the entire force. The STF is known for human
rights violations including killing people in their custody and
brutal, senseless, inhuman torture.
It was under these conditions that forced Afzal to leave his home,
family and settle in Delhi. He struggled hard to earn a living and he
had decided to bring me and our four-year old son, Ghalib, to Delhi.
Like any other family we dreamed of living together peacefully and
bringing up our children, giving them a good education and seeing them
grow up to be good human beings. That dream was cut short when once
again the STF got hold of my husband in Delhi.
The STF told my husband to bring one man Mohammad to Delhi from
Kashmir. He met Mohammad and one other man Tariq there at the STF
camp. He did not know anything about the men and he had no idea why he
was being asked to do the job. He has told all this to the court but
the court chose to believe half his statement about bringing Mohammad
but not the bit that he was told to do so by the STF.
There was no one to represent Afzal in the lower court. The court
appointed a lawyer who never took instructions from Afzal, or cross
examined the prosecution witnesses. That lawyer was communal and
showed his hatred for my husband. When my husband told Judge Dhingra
that he did not want that lawyer the judge ignored him. In fact my
husband went totally undefended in the trial court. When ever my
husband wished to say something the judge would not hear him out and
the judge showed his communal bias in open court.
In the High Court one human rights lawyer offered to represent Afzal
and my husband accepted. But instead of defending Afzal the lawyer
began by asking the court not to hang Afzal but to kill him by a
lethal injection. My husband never expressed any desire to die. He has
maintained that he has been entrapped by the STF. My husband was
shocked but he had no way of changing his lawyer while being locked up
in the high security jail.
It was only after the High Court judgement was pronounced he got to
know about the way the lawyer had represented him. Afzal refused to
accept the same lawyer for his appeal in the Supreme Court. I had no
way of getting Afzal a lawyer. I do not know anyone in Delhi. Finally
Afzal wrote to the Defence Committee set up for Mr Geelani. I am
annexing his letter. And the Defence Committee helped Afzal to get a
senior lawyer, Mr Sushil Kumar. However, the Supreme Court cannot go
into the evidence and so I do not know what will happen.
I appeal to you to ensure that my husband is not condemned to death
and he is ensured a fair trial. Surely your conscience will not allow
you to be a party to the death of a fellow human being who has not
been represented in the court and who has not had a chance to tell his
story? The police have made him falsely confess before the media even
before the trial started. They humiliated him, beat him, tortured him
and even urinated in his mouth. I feel deep shame to talk about these
things in public but circumstances have forced me. It has taken a lot
of courage for me to put all this on paper but I do so for the sake of
my child who is now six years old.
Will you speak out at the injustice my husband has faced? Will you
speak out on my behalf? I am of course fighting for my husband's life,
for the life of my son's father. But I also speak as a Kashmiri woman
who is losing faith in Indian democracy and its ability to be fair to
Kashmiri Muslims.

A place called Kashmir

When I started writing this blog in 2008 after land grab agitation I had never thought that writing will be so tough and inflicting. To narrate the day today events which are heart rendering will give sleepless nights.The oppression in Kashmir the atrocities the decimation and the genocide is so fast that one can cannot concentrate on a single case .It becomes difficult to choose on what atrocity by the occupational army to write let it be cold blooded murder of Kashmiri Kid of Nishat,Shopian hapless women,Sopore plundering etc etc.The value of a life in Kashmir is nothing for the occupational army who just for fun shoot at Kashmiri Kids, lure them to a boat ride and then drown them in the middle of the lake.Beat them when they are busy in playing.The events in Kashmir made me understand that no one in this world is concerned about what is happening in Kashmir and with Kashmiri Muslims.If a protester is beaten by shies in Tehran its becomes a leading news in the world. Unarmed protestors are showered with bullets by the Occupational army of India namely Slum Dog army let it be Gow Kadal,Habbak.Kangan,Chilal Uri etc.No one is moved.There is no place for Kashmiris to seek Justice.Killers are roaming free,Rapists are looking for new prey.People are scared to go out as they don’t know if they will return back to their family or not.Spongers like Omar Abdullah and Sagar have become puppet representatives of Kashmiris.Whom to ask for help? Pakistan? No ,Pakistani President Zardari one day calls Kashmiri’s terrorists , Second day his foreign minister finds Kashmir's struggle for freedom just.Saudi Arabia who boasts to be representative of Muslim Ummah is busy in catering Indian PM for its business.Help is awaited from no where.Kashmiris have to themselves get up and throw the oppressor out.For this we have to be ready for sacrificing our lives.When we will be ready then only something can be done.If we want our children to live in a free country then we have to give our today for the tomorrow of our nation.We have to sit on the streets and protest the occupation until UN intervenes and sends military to save us from tyrant India. In the uprising how many will get sacrificed will be the price for freedom.God never helps those who don’t help them selves.

Slum dog atrocities on Kashmiris a glimpse by the puppet CM








Jammu, Feb 25: Blaming opposition Peoples Democratic Party of having double standards, Chief Minister Omar Abdullah Thursday countered the Opposition with figures on human rights violation proving that more violations took place in PDP regime and added that he was ready to release all stone-throwers if area heads and elders give written assurances.


Asserting that stone-pelting was confined to few old-city areas, Sopore and Baramulla town, the Chief Minister said infiltration level and militant activities had shown a spurt in 2010.

Reacting to Governor N N Vohra’s recent address to joint session of the members of the Legislative Assembly and Legislative Council, the chief minister, armed with figures, said he wished PDP members could listen to his speech in the House. “The day I became the head of the State, I decided not to dig the past but the way PDP has been behaving here, I was forced to open all previous files,” Omar said.

Accusing PDP of being dubious, Omar said in the Assembly they show one face and in the District Development Board meetings, they shower praises on the government. “I believe the face they show in the DDB is their real face,” he said.

The chief minister said he wanted the Opposition to play a positive role rather than create problems unnecessarily.

“They sought debate on human rights and were allowed. Debate means discussion one a one-sided speech. They should have patience to listen us too,” Omar said.

He said they labeled National Conference-Congress coalition as ‘PSA government’ and ‘Adam Khor Sarkar’. “One thing should be clear that I will not allow some 800 stone- throwers to take entire Kashmir hostage,” he said.

He said: “In PDP regime, 1231 PSAs were slapped on people in three years. My government has slapped PSA on only 370 people so far,” Omar said.

The chief minister said PDP labeled coalition government as ‘Adam Khor Sarkar’ (Man Eater Government) but added that the fact was that in PDP’s three-year tenure, 2205 civilians were killed. “In my government, only 94 civilians got killed,” he said.

Omar said PDP had been saying that a sense of insecurity had increased among the people as women were being raped and molested. “Let me start from Farooq Abdullah’s time. In Farooq’s sahib’s six year term, 11 rapes and five molestations took place but in Mufti Muhammad Sayeed’s time, 38 rapes and 37 molestation cases were registered,” he said.

The chief minister said during Ghulam Nabi Azad’s term as chief minister of the State, only 13 rapes and seven molestation cases took place. “Keeping this in view, if PDP thinks, we would bow before their lies, they are mistaken.”

He said PDP had been maintaining in the House that the government had adopted “bullet for stone” policy. “They have forgotten when Mufti Muhammad Sayeed was Home Minister, bullets were showered on peaceful protestors at Gow Kadal where 30 people were killed. They have forgotten bullets were showered on the funeral of Mirwaiz Molvi Muhammad Farooq. How many records shall I open,” Omar said.

He said PDP talks about Zahid Farooq’s killing but doesn’t talk about the arrest of BSF man. “It was for the first time in 20 years that a trooper was handed over to Police. Can they (PDP) prove how many guilty troopers were handed over to police in their period,” Omar asked. “For the first time, International Human Rights Watch appreciated the State government for such a brave step.”

The chief minister said he was ready to release all stone-throwers if the area heads and Imams of Masjids would give him written assurance that those youth won’t indulge in such acts again. “If I receive assurance from the elders, I’ll release all stone-throwers tomorrow,” he said.

Omar said stones don’t hurt a politician but a poor man whose life depends on his day-to-day earnings.

The chief minister appealed youth to come forward and join the mainstream camp. “What for are you fighting? For the past 20 years, gun has not managed to move an inch of land from one place to other. How can stones help? Local bodies and Panchayats elections are coming. Come and fight these elections and raise your issues at a better platform,” Omar said.

He said stone pelting was confined to seven or eight police stations that include five police stations of old-city, Sopore and old town Baramulla. “So, it can’t be said that entire Kashmir is on boil. Kashmir is beyond these places,” Omar said.

He said 2010 has shown a surge in militant activities as well as the level of infiltration. “Year 2008 witnessed less infiltration. The level of infiltration increased in 2009 and it has shown a spurt since 1st January 2010,” the chief minister said.

He said security agencies had been directed to step up operations in Sopore area which witnessed increase in militant activities.

Omar reiterated that rehabilitation of youth who crossed over to Pakistan administered Kashmir in 1990s for arms training but now want to come back, was a must. “I have a proof that many youth are coming via Nepal on fake passports. We’re watching the activities of some youth who’ve come back. There are many youth who want to start their life afresh. They need to be rehabilitated,” he said.

The chief minister said the government was committed to address the issue of unemployment through Sher-e-Kashmir Employment and Welfare Program. “Unfortunately, PDP opposed this policy too. The policy is yet to be started but they opposed. I promise this police will be a success,” he said.
